EPR Authorization: Under E-Waste Management

EPR is a strategy that places shared responsibility for end-of-life product management on producers and all entities involved in the product chain, rather than the general public while encouraging product design changes that have the least negative impact on human health and the environment at every stage of the product's lifecycle. This provides treatment and disposal costs to be factored into the overall cost of a product. It places the major duty for design and marketing decisions on the producer, or brand owner. It also creates an environment in which markets arise that accurately reflect a product's environmental implications, and to which producers and consumers respond.

The procedure for Authorization of Manufacturer is stated in Section 13 ( 2) of the Act. Where it is stated that any manufacturer who generates e-waste must acquire permission from the relevant State Pollution Control Board. Every manufacturer must file an application with the relevant State Pollution Control Board. For the award of authorization, use FORM 1(a). That the authorization from the relevant state pollution control board will be valid for five years. That every person authorized under these rules must keep a record of the e-waste they handle in Form-2 and prepare and submit an annual return containing the details specified in Form3 to the concerned State Pollution Control Board on or before the 30th day of June following the financial year to which the return relates.

The procedure for authorizing a dismantler or recycler is as follows:

For the grant or renewal of EPR Authorization, every Dismantler or Recycler of e-waste shall make an application in Form-4 in triplicate to the concerned State Pollution Control Board within a period of one hundred and twenty days starting from the date of coming into force of these rules, accompanied by a copy of the following documents:

  1. Under the Water (Prevention and Control of Pollution) Act, 1974 (25 of 1974) and the Air (Prevention and Control of Pollution) Act, 1981, the concerned State Pollution Control Board granted consent to establish.
  2. A certificate of registration from the District Industries Centre or any government entity authorized to do so.
  3. Proof of plant and machinery installed capacity issued by the District Industries Centre or any other government agency authorized in this capacity.
  4. In the case of renewal, a certificate from the concerned State Pollution Control Board or any other agency authorized for this purpose demonstrating compliance with effluent and emission regulations, as well as treatment and disposal of hazardous wastes.

The procedure of EPR Authorization

  1. The maker or manufacturer of electrical and electronic equipment, as well as dismantlers, recyclers, and refurbishers, must first submit an application online to the central pollution control board (CPCB) or state pollution control board, together with all relevant documentation. You can also submit your application by completing Form-I on paper and attaching the needed documentation. Before submitting your documentation to the CPCB and the state pollution control board, double-check everything.
  2. Within 25 days after receiving the application, the Central Pollution Control Board (CPCB) and the state pollution control boards check and verify the application form and documents.
  3. If the CPCB and state pollution control boards are pleased with the submitted application, which includes the application form, documentation, and the extended producer responsibility plan, they give authorization after inspecting and validating the form and documents.
